access to the services and functionality that we may establish and maintain from time to time and in our sole discretion we may maintain different types of accounts for different types of users if you are accepting these terms and using the knowledge hub on behalf of a company, organisation, government, or other legal entity, then (a) you includes you and that entity, and (b) you represent and ebankit agreement to the extent ebankit has contracted with the user to provide access to documentation of ebankit to accomplish the subject matter of such agreement privacy and use of personal information any information that you provide to ebankit through the ebankit nxp knowledge hub, including email address, and any other information that includes individually identifiable information (personal information), will be collected, maintained and used by archbee (in accordance with their privacy policy, available https //www archbee com/privacy policy by using the ebankit nxp knowledge hub, you hereby warrant that you have properly obtained the appropriate legal basis and consent required by law to disclose the personal information to ebankit within the scope and during the performance of the service, archbee will process personal data of the platform users, namely email addresses of users personal data within emails which identifies or may be reasonably linked or complete you are responsible for safeguarding any password that you use to access the ebankit nxp knowledge hub and for any activities or actions under your password you agree to (a) notify ebankit of hereunder shall automatically terminate in all such cases, the terms shall terminate, including, without limitation, your license to use the ebankit nxp knowledge hub and to use all the information accessed by the user through the ebankit nxp knowledge hub nothing in this section shall affect ebankit's rights to change, limit, or stop the provision of the knowledge hub without prior notice disclaimers and limitations of liability please read this section carefully since it limits the liability of ebankit and its parents, subsidiaries, affiliates, related companies, officers, directors, available through the ebankit nxp knowledge hub (the “content”) is the exclusive property of ebankit or its licensors such content is protected by copyright, trademark, trade secret, and other applicable intellectual property laws certain content accessible through the knowledge hub may be licensed from or belong to third parties you agree to respect and comply with all intellectual property notices, restrictions, and usage terms relating to such third party materials you are granted a limited, non exclusive, non transferable, and revocable license to access and use the ebankit nxp knowledge hub and corresponding content solely for purposes expressly permitted under these terms and conditions no rights of ownership are conferred by such access any unauthorised reproduction, modification, distribution, transmission, or public display of the content is strictly prohibited you may not copy, reverse engineer, decompile, disassemble, adapt, or create derivative works from the extent permitted by applicable law, ebankit (including any ebankit entities) shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the knowledge hub; (ii) any conduct or content of any third party on, through, or associated with the ebankit nxp knowledge hub, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties; (iii) any content obtained from the partner portal; or (iv) unauthorised access, use or alteration of your transmissions or content in no event shall the aggregate liability of the ebankit entities exceed the greater of one hundred u s dollars (u s $100 00) the limitations of this subsection shall apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence) or otherwise, and whether or not the ebankit entities have been informed of the possibility of any such damage, and even if a remedy set forth herein is found to have failed of its essential purpose general terms waiver and severability the failure of ebankitto enforce any right or provision of these terms will not be deemed a waiver of such right or provision in the event that any provision of these terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining partnership agreement and all other terms and conditions relating to our websites are the entire and exclusive agreement between ebankit and you regarding the knowledge hub, and these terms supersede and replace any prior agreements between ebankit and you regarding the partner portal other than members of the group of companies of which ebankit inc is the parent, no other person or company will be third party beneficiaries to the terms notwithstanding the foregoing, nothing in these terms supersedes or limits your rights under (1) the terms and conditions of any written agreement you have entered into with ebankit regarding the use of knowledge hub, or (2) applicable laws or regulations to the extent these terms are prohibited by such laws or regulations in the event of any conflict between these terms and the terms and conditions of an applicable written agreement you have entered into with ebankit , the terms and conditions of the written agreement shall control we may revise these terms from time to time, the most current version will always be at the referenced link if the revision, in our sole discretion, is material we will notify you through the knowledge hub or through the email associated with your profile by continuing to access or use the ebankit knowledge hub after those revisions become effective, you agree to be bound by the revised terms correctness of information and disclaimer of warranty by using the co branded email functionality in the ebankit nxp knowledge hub, you and/or your co users warrant that you have the necessary authorizations and/or consents required to provide the customer / end user related data including the transfer of customer/end user data to the united states and/or other countries for storage, hosting and processing the portal and its contents and functionality are provided "as is", without warranty of any kind ebankit, on behalf of itself, its employees, officers and suppliers and those that have
